Three progressive organizations, Indivisible, Demand Progress, and the Revolving Door Project, sent a letter Tuesday evening to every Democratic Senate office, criticizing Sen. Kirsten Gillibrand because of her son’s relationships to crypto companies. The move undermines his efforts to comply with the pending CLARITY Act. It also shows that Senate Democrats who support the bill are dealing with politics, not policy disagreements.
The letter shows Gillibrand, chairwoman of the Democratic Senatorial Campaign Committee, is vulnerable to the same criticism from Democrats who have moderated President Donald Trump’s actions on crypto. The groups said that Trump’s attack on crypto profits will lose its power if the Democratic leader has close ties to the industry.
Meanwhile, Gillibrand has repeatedly called for elected officials and their wives to refrain from funding or supporting digital assets.

60 votes is a Hard Time
The CLARITY Act is the largest crypto market bill ever passed in the United States. Passage requires 60 Senate votes, meaning Republicans still need several more Democratic cosponsors than those who sponsored it in committee.
Sens. Ruben Gallego and Angela Alsobrooks voted for the Senate Banking Review committee, leaving the leadership to seek additional votes.
At the same time, the bipartisan ethics debate continues on several fronts. Sens. Bernie Moreno and Cynthia Lummis are working with the White House on joint language, while Sen. Thom Tillis leads a bipartisan debate. Although no plan has been released, reports suggest that negotiations are progressing. The debate remains focused on how the ethics code applies to public officials and their families.

Fairshake, the leading PAC in the crypto industry, is also involved in the discussion. The group has $125 million in cash, raising political awareness ahead of the 2026 midterm elections. As a result, both sides have incentives to cooperate, while progressive groups continue to warn of moral weakness.

CLARITY Act and GENIUS Act Echoes Return
The current situation is very similar to last year’s GENIUS Take action debate, while the Senate Democrats debate on crypto laws and cooperate with Trump’s financial companies. The bill won support from the Senate’s 18 Democrats after a lengthy debate. Now, the CLARITY Act is facing similar internal challenges, common-sense efforts, and another race against the legislative calendar.

Gillibrand is also at the center of the debate, and her ability to unite Democrats in a formal agreement could determine whether the bill moves forward. The Senate is expected to consider the legislation before the end of August. Until negotiators produce final language, the battle will focus on politics rather than legal documents.
