Health Care Providers Receive $59,500,000 in Settlement to End Alleged Collection and Disclosure of Heart Data

Three companies have agreed to settle a lawsuit filed over allegations that private data was shared with other companies without permission.

According to the newly updated website, period and ovulation tracker software Flo Health says he shared menstrual and/or pregnancy data by third parties after integrating software development tools (SDKs) provided by Flurry, Meta and Google.

The plaintiffs say that the act is against the law and they break it Flo Health’s privacy policy, which states it “will not share your personal information with third parties … unless we ask for your permission.”

Google has agreed to pay $48 million, Flo $8 million and Flurry $3.5 million of the $59.5 million.

Fees will be distribution for users who write interest on a pro-rata basis after paying fees, such as administrative fees, service awards, taxes and legal fees. Eligible are users whose data is shared with other companies.

“Unless otherwise noted, you are a member of the international Class if you used the Flo App in the United States between November 1, 2016 and February 28, 2019; and you entered bathing and/or pregnancy information in the Flo App during that time.

Unless otherwise dismissed, you are a member of the California Subclass if you used the Flo App in California between November 1, 2016 and February 28, 2019; you lived in California at the time; and you wrote information about menstruation and/or pregnancy in the Flo App at that time.”
